Former Federal Prosecutor Andrew Weissmann’s Concerns about Prosecuting Donald Trump

In a recent episode of the “Pod Saves America” podcast, Andrew Weissmann, a former federal prosecutor, shared his thoughts on what would give him sleepless nights if he were prosecuting former President Donald Trump. When asked this question, Weissmann responded by saying, “Jury nullification.”

Weissmann, who now works as a legal analyst for MSNBC, explained that he has encountered problems in high-profile cases with jurors who want to be on the jury but are less than truthful. He stated, “Usually most jurors don’t want to be on a jury, but in high-profile matters, you have that problem of somebody really trying to sneak on who is not intending to adhere to their oath of office as a juror.” He emphasized that it only takes one juror to result in a hung jury, even if the vote is heavily in favor of conviction.

Despite his concerns, Weissmann believes the evidence against Trump is strong, but he worries about the potential for a hung jury, which Trump could portray as a significant victory. Weissmann’s interview comes amidst reports that Trump received a “target letter” from the special prosecutor, giving him a short timeline to report to the Grand Jury.

Trump already faces indictment this year for alleged mishandling of classified documents and is scheduled to go on trial for the Stormy Daniels hush money payment case in 2024. Additionally, investigations into his actions to overturn the 2020 election result in Georgia are ongoing.
