Litman noted that the signals and witnesses being discussed in the investigation suggest that a grand jury may not be necessary, but it is customary. He also mentioned that Trump’s lawyers will be given a final opportunity to make a plea, although it is unlikely to succeed. Litman pointed out Trump’s escalating rhetoric about the probe, indicating that he may be aware of the potential indictment. Litman concluded that everything is in place for the investigation to proceed, except for Trump’s response. Smith recently sent Trump a target letter in the probe. Former acting Solicitor General Neal Katyal also predicted that Trump would be indicted this week, citing the significance of sending a target letter to a former president. Trump is already facing a trial in 2024 regarding the Stormy Daniels hush money case and is under investigation in Georgia for his attempts to overturn the election. He has also been charged with Espionage Act violations for mishandling classified documents after leaving the White House.
