A legal dispute is brewing between Bengaluru-based electric vehicle (EV) manufacturer Ultraviolette Automotive and iconic luxury motorcycle brand Harley-Davidson, following the latter’s recent foray into India’s competitive mid-capacity motorcycle segment with the launch of their most affordable offering, the X440.

The X440 motorcycle is a collaborative effort between Harley-Davidson and Hero MotoCorp, as part of their strategic alliance aimed at producing high-end motorcycles within India.

Ultraviolette has raised objections to the use of the ‘X440’ name, asserting that it bears a striking resemblance to their own ‘X44’ trademark, which was filed in September 2022. As per records available on the national trademark filings portal, Ultraviolette’s ‘X44’ trademark application is currently listed as ‘Accepted and Advertised.’

Hero MotoCorp, however, filed their ‘X440’ trademark application on November 8, 2022, approximately two months after Ultraviolette. Given that the X440 has already been launched and deliveries are scheduled to commence next month, the status of Hero MotoCorp’s trademark application now stands as ‘opposed.’
Notably, the ‘X440’ designation is a reference to the motorcycle’s engine capacity, which is 440 cc. In contrast, Ultraviolette has not disclosed any information regarding the significance or intended use of their ‘X44’ trademark. Currently, the EV manufacturer offers its maiden electric motorcycle, the F77, in the Indian market.It remains to be seen whether Ultraviolette’s ‘X44’ trademark might be linked to a future product they have in the pipeline. The outcome of this emerging legal battle will only become clear with time. In the event of an unfavorable ruling, Hero MotoCorp and Harley-Davidson may be compelled to alter the name of their maiden joint venture model. Either way, this dispute is an unexpected turn of events for the X440.
