Tcs: TCS gets notice from Maharashtra labour ministry over ‘forced transfers’: What the complaint claims

The Maharashtra government’s labour department has issued notice to India’s largest IT services company, Tata Consultancy Services (TCS), over complaints related to alleged forced transfers of employees. The complaint has been filed by labour union Nascent Information Technology Employees Senate (NITES). NITES is an organisation that works with IT/ITeS and related-sector employees.
The complaint filed by NITES claims that TCS transferred over 2,000 employees without giving them enough lead time to relocate to a different city nor provided them an opportunity for consultation, thus causing hardship to employees.
“The company had threatened employees that failure to comply with the transfer directions will result in disciplinary actions,” Nites president Harpreet Singh Saluja said in a letter to the labour department. Nites has asked the labour department to investigate TCS’ transfer practices to determine if it is in violation of state labour laws and take requisite action. NITES reportedly claims that it received more than 300 complaints, accusing TCS of systematically forcing employees to transfer to different cities.

TCS’ email to some employees asking them to relocate to Mumbai said, “… This is with reference to your transfer order to TCS Mumbai followed by a transfer email directing you to report to said branch within 14 days and complete the transfer process. However, it has been noted that you have failed to report to the transferred branch till date… the company is initiating a stoppage of your salary with immediate effect.” TOI has seen a copy of the email.

The labour department is said to have asked TCS to explain its stand on the matter during a formal meeting on January 18.
