Recent census data shows that Washington is 45% Black, while West Virginia is 93% white. The partisan argument made by Trump and his allies suggests that a predominantly Democratic and Black city, along with a Black judge, cannot provide a fair trial, unlike a predominantly Republican and white state where Trump enjoys support. Despite the arguments, a change of venue is difficult to obtain, as it requires showing “extraordinary local prejudice” against the defendant unique to the local region. Furthermore, the legal system has processes in place to assess and minimize juror bias. The charges against Trump include conspiracy to defraud the United States, obstruction of justice, and conspiracy against rights. The alleged criminal activity took place in Washington, D.C., which is why Trump has been charged there. Attempts to change the venue have been unsuccessful for other defendants in similar cases, with court precedents making it challenging to prove extraordinary local prejudice.
