WASHINGTON — Legal experts believe that former President Donald Trump is unlikely to be held in pretrial detention despite his threats of violence and unrest. Norm Eisen, a lawyer who worked on Trump’s first impeachment, explained that the courts will give Trump broad deference due to the First Amendment. Trump has been openly implying violence in his public remarks, particularly regarding the criminal cases against him. While this type of language would typically result in a request for detention for a defendant, experts doubt that the special counsel investigating Trump will make that request against a former president. Trump’s history of encouraging violence and making veiled threats would normally be considered by a judge, but it is uncertain if it would lead to his incarceration. The Department of Justice has not responded to queries about whether pretrial detention will be sought in light of Trump’s remarks. Trump’s staff has also not responded to requests for comment.
