(NewsNation) — A tentative date for a retrial for media mogul Harvey Weinstein has been set for sometime after Labor Day after the New York Court of Appeals overturned his 2020 rape conviction in a narrow vote.

He remains in prison serving a sentence for a 2022 rape conviction in Los Angeles.

The ruling gave prosecutors a path to retry Weinstein, though the decision hinged in part on whether accusers Jessica Mann and Mimi Haley would be willing to go through the experience of a trial for a second time.

Weinstein, 72, attended the hearing despite being recently hospitalized for unspecified health problems.

What evidence would be allowed at a new trial was discussed, as admissible evidence was the basis for the appeal.

The appeals court ruled the trial judge erred by letting three women testify about allegations that were not part of the charges and by permitting questions about Weinstein’s history of “bad behavior” if he testified, which he did not do.
